The damage caused by social media to children, families, and society is not hypothetical. It is documented, prosecuted, and lived.

So when countries begin drawing hard lines around children’s access to social media, I understand the impulse completely.

Australia Drew the Line. The World Is Watching.

In late 2024, Australia passed what is widely considered the most aggressive social media regulation to date: a nationwide ban preventing children under the age of 16 from accessing major social media platforms. The law places responsibility not on parents, but on the platforms themselves—requiring companies to verify users’ ages or face massive financial penalties.

This move has sparked global debate and intense scrutiny. Other governments are watching closely, including the United States.

According to Reuters, Australia’s law forces companies like Meta and TikTok to implement age-verification systems while explicitly prohibiting them from collecting excessive personal data.

It is a bold attempt to solve a very real problem.

The question is whether that approach could ever work in the United States.

I Agree Something Must Be Done, but Where Do We Draw the Line?

Let me be clear: I believe restrictions on children’s access to social media are necessary. Anyone who has worked these cases does.

But agreement on the problem does not mean agreement on the solution.

In the U.S., any serious attempt to restrict social media access for minors immediately collides with constitutional reality: the First Amendment, privacy rights, parental authority, and limits on government enforcement.

Unlike Australia, the United States does not have a tradition of centralized digital identity or national age verification. That distinction matters more than most people realize.

Will Kids Just Create Fake Accounts? Yes. They Already Do.

One of the most uncomfortable truths in this debate is also the most obvious: children already lie about their age online.

They do it effortlessly.

They have been doing it for over a decade.

Every investigator knows this. Every platform knows this. Every parent who has ever helped a child “set up an account” knows this.

If the enforcement mechanism relies on self-attested age, nothing changes.

If it relies on more invasive verification, the problems multiply.

How Would Platforms Even Verify Age, Without Becoming Surveillance Systems?

To truly verify age, platforms would need something stronger than a checkbox:

  • Government-issued ID
  • Biometric verification
  • Third-party identity services

Each option introduces serious privacy, data security, and constitutional concerns, especially when applied to minors.

Do we want children uploading IDs or facial scans to private companies whose business model depends on harvesting attention and data?

And if platforms collect that data, who secures it? Who audits it? Who is liable when it is breached?

These are not theoretical questions. Data breaches involving identity services are routine.

Is There an Enforcement Mechanism That Works in the U.S.?

This is where the discussion becomes uncomfortable.

In the United States, enforcement options are limited:

  • The federal government cannot easily compel speech restrictions without First Amendment implications
  • States cannot regulate interstate platforms cleanly
  • Parents retain primary authority over their children

Unlike Australia, the U.S. government cannot realistically mandate universal age verification without facing immediate constitutional challenges.

Even laws like COPPA, the Children’s Online Privacy Protection Act, focus on data collection, not access. And COPPA has been widely circumvented for years.

Which Platforms Would Be Covered, and Which Would Slip Through?

Most proposals focus on major platforms:

  • TikTok
  • Instagram
  • Facebook
  • X (formerly Twitter)

But in many investigations, the harm does not begin there.

It begins on:

  • Discord servers
  • Telegram channels
  • Gaming chats
  • Anonymous apps
  • School-adjacent platforms that operate outside public scrutiny

These spaces are harder to regulate, harder to monitor, and often completely overlooked in public debate.

If laws only apply to the largest platforms, behavior will migrate, not disappear.

Who Is Ultimately Responsible?

This may be the hardest truth to accept.

Parents remain the first line of defense.

Platforms bear responsibility for designing systems that knowingly expose children to harm.

Government is reactive, constrained, and often years behind the technology it seeks to regulate.

No single actor can solve this alone.

Has Social Media Grown Too Big to Regulate Within the Constitution?

This is the question no one wants to ask.

Social media platforms are not just communication tools. They are algorithmic behavioral engines operating at global scale.

The U.S. Constitution was not written with this reality in mind.

That does not mean the Constitution is obsolete. It means our expectations of regulation must be realistic.

We may be facing a future where:

  • Perfect enforcement is impossible
  • Partial measures reduce harm but do not eliminate it
  • Cultural change matters as much as legal change

Where Do We Go From Here?

Australia’s approach is bold. It may reduce harm. It may also reveal limits that others ignore.

In the United States, meaningful progress may require:

  • Shifting liability incentives for platforms
  • Strengthening device-level parental controls
  • Honest public acknowledgment of enforcement limits
  • Education grounded in reality, not fear campaigns

We should act, but we should not pretend this is simple.

Protecting children matters. Preserving constitutional freedoms matters too.

The hardest part is admitting we may not be able to fully achieve both, and deciding what we are willing to accept as a society.
